Vacation Rental Agreement and Rules 
 

WHAT WE PROVIDE:  You will find most of the items you are normally accustomed to having in your home at Bear Mountain Lodge, which is well equipped and fully furnished.  This includes bedspreads, linens, blankets, pillows, towels, soaps, shampoos, laundry facilities, a fully equipped kitchen, TV, DVDs, and furnishings.  To make your arrival more comfortable, you will find milk, eggs, and butter in the refrigerator. There are assorted cereals, pancake mix, coffee, tea, hot chocolate, popcorn, rice, spaghetti, mayonnaise, mustard, spices, flour, sugar, cooking oil, and paper products.  If there are special items you are accustomed to using, please bring them with you.   

AGREEMENT:  We do not rent to individuals under the age of 21 unless accompanied by an adult guardian or parent.  The undersigned is an adult and will be an occupant of the lodge during the entire reserved period.  Other occupants will be family members, friends, responsible adults, or children under direct adult supervision. Use of the premises can be denied to persons not falling within the foregoing categories and as a result, they will be required to vacate the property without any refund. Any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the rental agreement and forfeiture of your security deposit and rent. 

PAYMENT & CONFIRMATION PROCESSING FEE:

• A processing fee in the amount of $100 or 10%, whichever is greater, is required to secure and confirm your reservation.  This amount is non-refundable and will be applied toward the total amount due.
• 30 days prior to your arrival, payment of the remaining balance is to be received in full. 
• Reservations made within 30 days of the arrival date require payment in full to confirm the reservation. 
• Damage Deposit A separate damage deposit is not required, however, a credit card authorization must be provided and kept on file in case of damage. If, after your departure, items are found to be missing, damaged, or keys are lost - charges to cover said amounts will be made based on the assessed value of the missing or damaged items.

 

CANCELLATIONS:  A thirty (30) day notice is required for cancellation. 

• If cancellation becomes necessary and is made more than 30 days prior to your arrival date, you will be refunded advance payments you have made, with the exception of the non-refundable confirmation-processing fee; and a fee for payments made by credit card.  Cancellations involving advance payments made using a credit card are subject to a 5% processing fee. 
• If notice of cancellation is received less than 30 days prior to your arrival date, advance payments will be forfeited unless we are able to re-rent the property for the same period.  In the event the property is re-rented for less than the original period, advance payments will be refunded less the amount necessary to make full payment to the property owner.  Accordingly, you hereby authorize charges to your credit card for any outstanding balances for reservations cancelled less than 30 days prior to your check-in date.
• Changes in reservations that result in a shortened stay, and which are made less than 30 days prior to arrival date, will forfeit advance payments for cancelled dates. 

INCLUSIVE FEES:

• Rates include a one-time linen, towel and condiment set-up.  If you desire a mid-stay change out please let us know. For an additional fee we will try to accommodate your needs.
• Rates include normal cleaning.  The poperty is inspected, cleaned, and sanitized after each departure.  You are required to leave the property in the same general condition that you received it by making sure dishes are washed and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. 

 

OTHER:

• To assure the personal comfort of all our guests, we do not allow smoking or pets
• The property is equipped with a telephone to be used for local calls and emergencies only.  YOU MUST USE A CALLING CARD OR CALL COLLECT WHEN MAKING LONG DISTANCE TELEPHONE CALLS.  Tenant agrees to pay long distance service charges and a bookkeeping fee of $15 for all long distance charges made during the period of stay. 
• The property includes a hot tub, which can be dangerous if not used properly.  Injury is likely to occur to anyone who is not careful.  The undersigned accepts and assumes all risks involved in or related to the use of the hot tub and hot tub area; and agrees to observe and adhere to all rules and policies as posted.
• The lodge is on a well and septic system.  The septic system is very sensitive and will clog up if improper materials are flushed into the toilets. DO NOT flush diapers or feminine products down the toilets at any time.

MAINTENANCE: 

We will diligently attempt to address maintenance issues as they occur.  If a maintenance issue occurs that cannot be fixed in a reasonable amount of time, and significantly affects your stay, we reserve the right to provide a refund at our discretion and/or relocate you to another property.  Regularly required maintenance and services may be required during your stay.  We try to present as little impact or inconveniences to your stay as possible. These services may include things such as lawn and gardening, hot tub servicing, and/or limited brush clearing. 

WEATHER / ROAD CONDITIONS:

We highly recommend a front wheel drive, and/or chains or four-wheel drive during the snow months. No refunds will be given for weather or road condition delays, including air travel delays. If roads are closed for more than 8 consecutive hours, refunds will be considered on a case-by-case basis.  However, we highly recommend you purchase travel insurance. The Lodge is subject to snow and freezing conditions that can create dangerous conditions for walking and driving; therefore, care and caution should always be exercised.  

EXPRESS INDEMNITY:

Neither the homeowner nor agent is responsible for the loss of personal belongings, valuables or for any accidents, injuries or illnesses that occur while on the premises.  By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises. The undersigned fully releases the owner of the property, and agent, from any and all claims in connection with the occupancy of the premises and agrees to hold the owner, and agent, free and harmless of any claim or suit arising there from.  

ENTIRE CONTRACT:

All prior agreements between the owner, agent and tenant are incorporated into this Agreement, which constitutes the entire contract between all parties.  Any provision that is held to be invalid shall not affect the validity or enforceability of any other provision.  This Agreement shall be governed in accordance with the laws of the State of Washington.
